4. No opinion without including a test of political application by selective prosecution seems fair. The test would be equal application of the charges by the courts. This forces political charges to be challenged by any judge at any level. Actually such a ruling would side with many appeals and current charges. That ruling is supported by several amendments of the constitution.

5. Yesterday’s message from the rightwing justices of the Supreme Court, particularly the male justices, was shocking to any believer in true, conservative jurisprudence and the rule of law. Their questions at the oral argument in the Donald Trump immunity case signaled strongly that they really care more about enhancing presidential power than preserving democracy, and to that end, lean toward giving Trump the gift of even more delay.

   Trump, the former president and Republican presidential nominee-in-waiting, is accused of trying to overturn an election in the weeks before January 6. He has said the “constitution should be terminated” and that he will be “a “dictator on Day One.”

   In that context, Americans want to know before they vote if Trump is innocent or guilty of using unlawful means to interfere with the 2020 certification of President Biden’s election. We deserve that knowledge.

   The Supreme Court, however, has no such care. In the stunning words of Trump appointee Justice Brett Kavanaugh, “I’m not concerned about the here and now, I’m more concerned about the future.” Justice Samuel Alito said he didn’t want to talk about the “particular facts” but rather to talk “in the abstract.” To the same effect was the statement of Trump appointee Justice Neil Gorsuch: “We’re writing a decision for the ages.”

To go after a former President on criminal charges that he "committed" while in office he would first need to be impeached by the House and then found guilty and removed by the Senate. Once found guilty and removed he could then face charges otherwise back off. Trump was not found guilty by the Senate.
