The ‘real’ Shiv Sena
SG Tushar Mehta: I cannot argue politically.. I am not on dual capacity. An unconnected letter was presented before your lordships of the Governor..
CJI DY Chandrachud: Sr Adv Sibal does not expect us to refer this to in our judgment. We only smiled. Just smile…
Mr. Sibal said that, looking at it in its entirety and impact, the EC order was also concerned with the question of who was the “real” Shiv Sena party.
“But equally, Mr. Sibal, now they [Shinde] have succeeded before the EC. We cannot pass an order which has the effect of staying the EC order without hearing them… We cannot stay the EC order at this stage,” Chief Justice Chandrachud noted, while issuing notice in the case.
The court gave two weeks’ time to Mr. Shinde and the EC to file their responses to Mr. Thackeray’s challenge to the February 17 order. Mr. Thackeray will get a week thereafter to file his rejoinder, after which the case will come up for hearing again.
Mr. Sibal repeatedly urged the Bench to at least give them the liberty to approach the court in case the Shinde group took any “precipitate action”, leaving the Thackeray faction high and dry, in the interim weeks before the case came up for hearing.
However, the court remained non-committal. It brushed aside Mr. Sibal’s fears, observing that his worries concerned issues quite outside the EC order and touched upon “contractual relationships within a political party”.
The court however retained the Election Commission (EC) direction allowing the Thackeray faction to keep the name ‘Shiv Sena (Uddhav Balasaheb Thackeray)‘ and the flaming torch symbol for the upcoming byelections in the Chinchwad and Kasaba Peth constituencies.
At one point during the hearing, Mr. Thackeray’s team of senior advocates Kapil Sibal, A.M. Singhvi, Devadatt Kamat and advocate Amit Anand Tiwari said that they feared that the Shinde group, armed with the EC order, would issue a whip and even disqualify Mr. Thackeray if he did not comply with it.
Role of Judiciary in India
As a judiciary is independent of the executive, it can easily safeguard the rights of the citizen to ensure peace and harmony. However, its role is not just limited to this. It plays different roles to make sure there is smooth functioning in the country.
Firstly, it plays a great role in making new laws. Judiciary is the rightful interpreter of our constitution as well as the current laws. It has the power to create new laws as well as overrule policies that might violate our constitution.

  1. SG Metha is nothing but a modi parasite that is partner to dictatorship. It's ridiculous that this coup and illegal occupation and hijack was justified. Disgraceful that we have to hear with rogues of Modi's haven

  2. 50 kokhe mein ek ek MLA bika tha Modi ji ne sab Ed CBI enquiry case daalne par Shinde ne yeh fraud Kiya tha

  3. E sab drama becha becha ko maalum he. 2sal se sab dek reha he. What themeaning of 10th schedule?.

  4. The governor's role has already been identified as illegal in the past then why are they going round and round the bush discussing the same thing. It's clear that the shiv sena has been fraudulently split and the symbol stolen from the true holder and gifted to a fakester.

  5. Why uddhav resign? Why he not faced house? He was sure that he will loose on floor of the house.

  7. Is this argument going on again? Or is it replaying the earlier hearing, after all this CJI allowed the illegal government to continue.

  8. The governor and whole ruling party Administration helped in breaking up Shiv Sena party lead by Udhau Thakure and now SG is doing the same act and is trying to justify act of Governor which was wrong.

  9. Salute to Mr. Mehta, who understands that what happened was unconstitutional, still keeps on blabbering and trying to mislead the SC.

  10. It' isd pity that hon.cji wasting his energy in listening to the Big manipulator and shameless SG Tushar Mehta!!!

SG has an Arrogant Head!!. Throwing all norms to winds… mr.modis man de grading the SG Position to the rock bottom in the history of Indian Judiciary

  12. SG's point on breach of prepoll alliance is also fundamental as it is the origin for going against the mandate by the people. Later permutations and combinations happen when majority of a ruling party move on.

  13. When lodrships are replaced by AI likwise EVM. Machines can always be manipulated. Don't think I am against EVM but I can't believe bureaucracy. They are corrupt.

  14. This is in practice of BJP to dislodge the elected governments by hook or by crook.

  15. Amazing
Amazing, why we require election? Just allow the government servants to do the job. Democracy parliament supreme. Everything being questioned. inheritance in judiciary must be stopped.

  16. India Supreme Court has no power, simple case is running last one year. Rulling party is has more power then Supreme Court
