  1. Here is my theoretical defense: I admitted to the crime because I thought I was offered immunity. While I did not do it, I agree with and support the act and want to protect whomever that did do it. And if I admit to it leveraging the immunity, the case would be closed and they would be so protected.

    Essentially admit to perjury to walk back on the murder confession. The logic is sound enough that it can create reasonable doubt if there is no other collaborating evidence. I also won't be surprised if this happened, if rarely, at some point in some case.

    This is why that I do think that confession while being lied to is weaker, especially if immunity is involved, as there are plausible alternative theories.

  4. To answer simply, Law & Order was cancelled due to it being a bit too much of an ask from a budget standpoint. The problem stems from budget cuts & trying to lower costs to avoid cancellation, and that’s on top of ratings falling through the floor.

  5. Regarding the charge of Murder Two: in New York State, premeditation is not sufficient to support a charge of Murder One. Murder One is reserved for murder that is premeditated "with special circumstances", which usually means that the victim was a law enforcement officer or somebody else whom the government apparently believes is a more valuable human being than any member of the unwashed hoi polloi.

  6. I know this will probably never happen, but who wants Legal Eagle to react to the courtroom episode Psych, Cloudy with a Chance of Murder. They get so much wrong but there are these little details they get so right. Like the prosecution withholding evidence bites them in the butt big time. They also recall a witness, and, while there was some funny business in the interrogation, the reason for the recall is also actually valid. Prosecution literally gets a video authenticated last minutes that they recall the witness to address an alternative theory from the one offered by the prosecution.

  7. Is it required by law to have a lawyer present when being questioned by the police either at a police station, on the streets or at home or anywhere else?

    Occasionally, I get a case file where a client that invokes. It isn't common.

  11. For the record: Jack McCoy is a snake. Also, from all citizens, how do Officers expect us to tell them the truth when they don't respect us enough to do the same? Officers complain about being lied to when they do the same thing. Either say the truth or stop complaining.

  12. Police lies lead too a lot of people confessing to crimes they didn't commit. Let's not act like it doesn't happen.

  14. Most people can't afford a lawyer and/or have no idea how to get one and don't know that just speaking the truth is wrong.

The only thing this video did is remind me that the legal system has little to do with actual justice and that it often fails victims and/or retraumatizes them after failing them and they are the ones left to pay for it for the rest of their lives, one way or another. The legal system is a sick joke.

  17. I watched the season premiere, which was bad enough that I figured I would skip to the season finale. Let me tell you, that's a whole lot worse. I think my wife got sick of me yelling at the TV 😂

But the part of that interrogation lie that just broke me and made me wish that detective would get stuck in a dark room full of legos coated in lemon juice was the implication that he would help her. Especially when coming to an SA victim, yeah sure it wasn't illegal but he is a vile human being to do that to someone who was failed by the system before. Watching that, and her fear just broke my heart. That poor woman had already been broken before, and yes she committed a crime and needed to face consequences, but he went that extra step to break her further in the process. It made me feel physically ill to watch.

  20. So what it was a confession from a lie? Exactly what the Ada said. It is less reliable. It may be legal, but it is also often false.

    Because she was being told killing him was a good thing. She was being told she would be famous and adored by the public. He gave her a reason to WANT to be known for killing him.

  25. I mean, I know this is about what's LEGAL, not what's moral, but I don't get why Devin was so blase about lying to the suspect and "it doesn't feel right". The woman was a victim who was denied justice. If the outcome of that (fictional) trial sits completely right with you, you need to examine your morality pretty closely. It was correct, but it wasn't right.
