  1. Could be that he is so sure his alibi will hold and get him out of this because it's fabricated (that's what he was studying?) and this really is his try to commit the perfect murder.

    OR this could be his real alibi and the state knows they can't disprove it and fight against it that hard because they know it's the truth and just want him guilty because they have no other leads.

  2. Bill Thomson seems pressed AF why don't they hand over the IGG evidence? And it's kinda ironic the LE used Cellular data in there charges against Bryan, yet the defense who also have brought in someone to provide evidence that disputes the Cellular data they LE filed seems is not good enough for the State! Have they got 100% CCTV evidence that shows Bryan at the property? Have they got 100% slam dunk evidence that it's Bryan's car on CCTV? Doesn't seem so, so basically him driving around isn't a good enough Alibi? Sounds a bit wishy washy on the Defense side for sure, but the fact It's a normal thing for Bryan to drive around at night, go for Hikes & Runs has already been proven it was completely normal for the guy, there is even People who used to go on runs with Bryan at 3am that have publicly stated this, so if anything his Alibi isn't as poor as some believe, if he can prove he was elsewhere which seems the defense has got some receipts and even a witness to testify that should be enough! Let the guy show his defense at least. Seems the States bothered Anne Taylor isn't let them sit on discovery even publicly accusing them of withholding it, if it's such slam dunk bang to rights evidence the State have then give it to the defense.
    Don't care what anyone says I think what the State has is mostly Exculpatory at best, and are showing their asses, the delays and stalling to me seems they are trying to fix the cracks around the discovery before they hand it over so they don't get railroaded by the defense.

    Seems they are trying to make the shoe fit.

  3. The state could be irritated at the defense "dragging their feet" in a case of 4 dead students.

  4. It just doesn't meet the definition of an alibi – right? If you allow that doesn't it dilute the definition for future cases? Precedent?

  6. It always concerns me how you prove you weren’t somewhere. I’m a single parent, from 8pm I’m home alone and my child is asleep. I’d never have an alibi if someone accused me of something after dark, it’s a scary prospect to have to prove you weren’t somewhere

  7. He previously drove around the area at night, and conveniently had his cell phone on. This is what is commonly known as “casing the joint”. Then just by chance on the night of the murder his cell phone didn’t register. It would be interesting to know what areas in the locality does not have cell phone reception.

  9. It's a trap . The prosecution won't say when the time of the crime is. If BK says " I was exactly here, exactly when the crime happened" then prosecution will go "Aha, so you know when the crime was? Guilty!"

  10. Can Kohberger be his own alibi? There is a knife purchased on Amazon and a DNA on the knife case snap at the scene. Victims need TIMELY case – not endless nonsense by a smart ass defendant!

  11. Given how bad the state has been about turning over discovery, it’s pretty rich for them to whine about discovery from the defense.

  12. I think it’s more important that he gets a fair trial, and it doesn’t sound like they are being fair to me.

  13. There is a chance that the defenses expert will testify about the GPS on his phone or pictures on his phone. The thing people forget is that electronic forensics is BKs specialty . He knows exactly what is on his phone and how to access it. This is just 😢 my opinion as someone who has followed this case very closely through court documents and his application to work with the police department, University.

  14. Brian didn't do this thing. He is their patsy. You all can argue the law all you like, but until they admit they don't have enough real evidence, he's doomed.

    If I said I was asleep in bed is that specific enough or do I have to specify left or right side of the bed, or even in the middle?

  16. I’m a bit confused. If the prosecutor and defence has ‘evidence’ that they think prove the innocence or guilt of the BK then I would have thought that it was important that all ‘evidence’ was handed over to each other to give the opposing team time to fully prepare for the court case. I think it would be good lawyering to fully explore evidence even if you’re certain of your case. What if one side told a blatant lie and the other side hadn’t had a chance to explore the legitimacy of it. I’d imagine it could either lead to reasonable doubt or even convict someone on evidence that hadn’t had a chance to be proven or disproven. I wouldn’t think it smart to go to trial until all opposing evidence was explored fully. So comments like, ‘it shouldn’t matter if they don’t have all the evidence if they are so sure of their ability to prove innocence or guilt’ is a reckless way of looking at it.

  17. In the Murdough case it was glaringly easy to see him as murderer purely from the multiple police interviews and body cam from the night. It's embarrassing…

  24. Im sorry I understand the state's apprehension because Kohberger is a criminal law graduate so I would also not put anything passed him. This guy has been playing cat and mouse games since day one. He planned every single detail because he decided to see if he can commit the perfect murder and get away with it, the wet dream of any pshyco, which I completely believe him to be. His own sister immediately suspected him when the murders came on the news, WHY???

  25. Didn’t the alibi hint that there is or should be GPS data, either from the phone or a cloud service? Wasn’t there something about the state potentially hiding or destroying exculpatory GPS data? Could this be why they are now scrambling and trying to limit what can come in?

  26. I wish he would just collect all video footage of his driving route where his car would have been seen… There are way too many cameras around for him to not have been caught on some camera in the area he was allegedly driving.

  27. Maybe the state is worried. Maybe they are worried that they have the wrong guy, and they genuinely want to know if there is proof it wasn't him.
