In California, after a prosecutor files a felony complaint with the court, California criminal law requires the judge to hold a preliminary hearing (oftentimes referred to as a “prelim” or probable cause hearing). Witnesses testify, and the defense lawyer has an opportunity to cross-examine them.
The purpose of the preliminary hearing is to determine if there is enough evidence to justify holding the defendant to answer for the alleged charge(s), which includes any misdemeanors that are charged along with the felonies.

Penal code 738 requires that a preliminary hearing must be conducted before a charge ( information) is filed. You dont see that happen in california now these days and is a rules and procedure violation.

What happens if the victim or witness doesn’t show to prelims but only the officer that took the report does? The alleged bad guy was never at the Seain there nor did he ever talk to the police on the day the alleged crime was committed?
Back on on feb25th me and my little dog got brutally attacked by some sadistic monster,, we had went to the neighbors house to ask for help ,, this guy had waved at us for years passing through my perents property with there horses,, my perents are narcissist cognitive dissonant type ,, back in aug2019 I got put on ssi ,, that's when they began calling 911 on me claiming I was abusing them ,, of course I was not the cops came many times but never gave me a charge ,, my perents still kept there agenda going of trying to get control of my ssi by calling 911 claiming lies of abuse apparently hoping they could get me labeled as dysfunctional , because they didn't like something I would say in defence to there narcissistic attacks they would get triggered n boom 911,,this was in yucca valley a country setting outside of the city ,, during these times I could not find any place to rent as the 911 calls would continue I figured if I go to the neighbors with the horses and ask them to call the police would get there sooner because they called so many times I would have to wait a long time ,, I did this once before with the neighbors with the horses,, they did come quicker that day ,, the 2nd time I went there same issuie the neighbor thomas hennery boyles at 58379 san Andreas yucca valley ca was getting something out of his truck ,, with my dog in the back pack as I walked closer he began walking towards us normal looking as I began to introduce greeting him with " high I'm your neighbor "" then boom he sucker punched me and went into killer mode ,, next thing I know I'm on the ground pinned down and he's beaten me in the face and ribs ,, I said please dont kill me and exsplaind my self as he kept beating me ,, he stopped at some point still having me pinned down and called the cops ,, thomas hennery boyles is apparently xmilitary xcop and xda of Joshua tree courthouse,, he lied to police making up some story about me going into his garage acting crazy and swinging my sk8board,, they charged me with felony assault attack with a deadly weapon,, then I also got felony assault for my father with elderly abuse on both charges,, me and my lil dog were the only ones hurt because in reality I did not attack anybody ,, I'm fighting the case they did a conflict of interest and sent the case to victorville ,, there was 2 houses across the street that may have had filmed the attack that happened at the right side of thomas hennery boyles 58379 san Andreas yucca valley ca also I know thomas has a ring cam thas saposedlly the public defender investigator will try to sapina at least mabey the audio will clear me ,, i am 40 years of age and have no criminal record/ history does anyone here have any help /recommendations for me and my dog ?
The problem is there are way too many idiot Law Enforcement Officers out there who think they know the law. There are also too many District Attorneys who push a bullshit case so they have a justification for their paycheck. The DA's are often way too buddy-buddy with defense attorneys as well, it's all about the money
