The weird background music got distracting for me.
Anything is "indicia of intoxication" to a cop. If they can't legitimately find anything, they'll just make something up, which will have been conveniently not caught on camera. Perjury, junk science, and manipulation of evidence are a cop's favorite tools to justify fake DUI arrests and pursue convictions.
If i was a juror not guilty.
Before the cop even pulls you over, they have already decided they are going to arrest you for DWI. Everything he sees is filtered through that lens of confirmation bias. Even if someone passed the FST and blows a 0.0, the cop still arrests. It has also been proven that must PD have competitions and pools for the most DWI arrests on a shift. Doesn't matter if the case gets tossed. They are rated on arrests.
I'm over 60. Been sober 40+ years. I'd fail a FST due to arthritis. In most states PD can't administer FST to anyone over 60. But some do regardless any law to the contrary.
