ABOUT MASSAD AYOOB:
Massad Ayoob has been handgun editor of GUNS magazine and law enforcement columnist for AMERICAN HANDGUNNER since the 1970s and has published thousands of articles in gun magazines, martial arts publications, and law enforcement journals. He is the author of some twenty books on firearms, self-defense, and related topics, including “In the Gravest Extreme” and “Deadly Force,” widely considered to be authoritative texts on the topic of the use of lethal force.

The winner of the Outstanding American Handgunner of the Year Award in 1998, Mas has won several state and regional handgun shooting championships. Ayoob was the first person to earn the title of Five Gun Master in the International Defensive Pistol Association. He is the current President of the Second Amendment Foundation. He served 19 years as chair of the Firearms Committee of the American Society of Law Enforcement Trainers, and several years as a member of the Advisory Board of the International Law Enforcement Educators and Trainers Association. In addition to teaching for those groups, he has also taught
for the International Association of Law Enforcement Firearms Instructors and the International Homicide Investigators seminars.

Mas has received judicial recognition as an expert witness for the courts in weapons and shooting cases since 1979, and served as a fully sworn and empowered, part-time police officer for 43 years, mostly at supervisor rank. Ayoob founded the Lethal Force Institute in 1981 and served as its director until 2009, and now trains through Massad Ayoob Group. He has
appeared on CLE-TV delivering continuing legal education for attorneys, through the American Law Institute and American Bar Association, and has been retained to train attorneys to handle deadly force cases through the Armed Citizens Legal Defense Network. Ayoob served for two
years as co-vice chair of the Forensic Evidence Committee of the National Association of Criminal Defense Lawyers. He also appeared in each episode of Personal Defense TV (Sportsman’s Channel).

  1. This is absolutely TERRIBLE advice. Do not talk to the police. If you can’t afford a lawyer, sit it out.

  2. Strange he didn't make a statement after speaking to his lawyer. That would have saved him 8 days but I agree, never say anything without legal representation.

  3. See here's the thing, what happens if the cops in Colorado(uber liberal state) weren't so understanding? Yeah it could happen.

  4. I was detained after a self defense incident. The investigator had me out that night at 10pm and my attacker got a slap on the wrist, but even the investigator told me that I should've pulled the trigger. Good men. I'll miss that part of the world

    Believe it or not, some people don't have an attorney in his "back pocket"…. or on call or on retainer…..
    Especially at 05:00 in the morning.

  6. To hell with that, never trust the police. Theyre not your friends, they arent there to help you.. theyre there to make an arrest/give a ticket, simple yes or no answers. If that leads to a few days in jail vs potebtially the rest if my life. So be it.

  7. One case doesn't make a rule. Most people will talk themselves into more problems, not less. Just get insurance from USCCA or similar and follw their procedures.

  8. I would probably say as little as "he broke in my house" and defer all questions to my attorney. A detective never stops at one question.

  9. Arizona quite possibly has the best stand your ground and defend the castle laws on the books.
    The burden of proof is not on the defendant in defend your home cases. The State has to prove that you were NOT in fear for your life when self defense comes into play.
    Still, just tell the officers that you are invoking your Fifth Amendment right to remain silent. They cant even ask you your name. They cant ask questions. That is a violation of your civil rights. Qualified Immunity now is nullified.

  10. This may have been good advice 30-35 years ago but not anymore. Do NOT talk to the Police. Call 911 and drop your phone where you are. Let the 911 recording pick up what happens.
    Talking to the police is Horrendous advice.

  11. Invoke your Fifth Amendment rights. Speak to an attorney. Never, Ever talk to the police. They are not our friends. Even the police and attorneys from the DA teach their own kids not to speak to the police.

  15. I would say talk to the police if you know how to articulate that you had a reasonable fear of imminent death or great bodily injury. Most cops just want to do the right thing, just like most people in life.

  22. Massad is giving you the correct advice. He’s a subject matter expert. All you need is a very brief statement. “I was watching TV. Guy started breaking down my door. Retrieved my weapon. I shot the bad guy as he entered my home. He fell down. I don’t know if anyone else was involved. Other than providing you my biographical information I don’t wish to answer questions at this time. I assert my 5th amendment rights. Here is the weapon I used (in a holster).”
