Criminal Law II is a very, very long subject, kapatid. The most important piece of advice I can give you is that there is a very, very strong probability that your class will not finish the course. Maraming professor ang pilit na tinatapos ang Criminal Law II at madalas, ang resulta ay napaka-babaw ng appreciation natin sa criminal law. This approach is logical – hindi naman lahat ng krimen sa bansa ay tinatanong sa bar exam.

At the end of the semester in law school in the Philippines, your learning objective is that, you should be able to combine the things you learned from Criminal Law I and II. You are expected to know whether the following combination of actions amount to a crime, the degree of criminal liability and the prescribed penalty.

  2. To answer the question refer to the elements of Article 247

    For Article 247 to apply, the defense must prove the concurrence of the following elements:
    (1) that a legally married person surprises his spouse in the act of committing sexual intercourse with another person;
    (2) that he kills any of them or both of them in the act or immediately thereafter; and
    (3) that he has not promoted or facilitated the prostitution of his wife (or daughter) or that he or she has not consented to the infidelity of the other spouse.

    In the case of PP vs. ABULENCIA [ G.R. No. 241088. June 03, 2019 ]

    1st Scenario: Liable; 1st Element is not present;
    2nd Scenario: Not Liable, applying statutory construction, RATIO LEGIS (Ratio legis est anima)Interpretation according to the spirit of the law; the reason of the law is its soul.
    3rd Scenario: Liable; 1st Element is not present;
    4th Scenario: Liable under Article 4 Error in Personae;
    5th Scenario: Liable, 2nd element is not present.

    1. Wife surprised the husband in their bedroom pero hinahalikan ang kasambahay – LIABLE, kissing, hugging, or yung "naghahalikan" is not in any way a form of sexual intercourse.
    2. Wife surprises the husband in their bedroom pero sa driver nakapatong – NOT LIABLE – Article 247 expressly states that the sexual intercourse is being committed WITH ANOTHER PERSON, it was not stated that it has to be a male or a female
    3. Wife surprises the husband in her bedroom with wife's best friend – NOT LIABLE , intercourse performed "in the backdoors" are also acts performed during a sexual intercourse
    4. Wife surprises husband's twin in her room – NOT LIABLE, mistake of facts could be brought up in defense of wife's actions (kasi kambal ng asawa niya ang involved)
    5. Wife learns that her husband is engaged in adult films / helper – LIABLE since the element of "surprising her spouse" did not really happen and that there has been a certain period of time for the wife to "premeditate the killing" and that the husband and the helper themselves weren't conducting ACTUAL SEXUAL INTERCOURSE when the wife killed the helper.

  6. Is that applicable sir in this scenario the crime of passion?If the wife can provide a evidence that her husband is engaging a sexual intercourse with their maid mentioned in last sentence?That can help her for the acquittal criminal liable for committing Paracide.

    Jail Officer po ako, gusto ko din po mag aral ng law, Licensed Criminologist din po ako, if ever mag aral ako ng law , ma cre-credit po ba yung subject like criminal law book 1&2, legal medicine. ? Yan po yung subject namin sa criminology na meron din po at sa law..
