The Law Commission is an executive body which is established by the government for a fixed tenure. It acts as an advisory body to the Law Ministry and comprises legal and judicial experts. In February 2024, the Law Commission of India submitted its 285th report titled “The Law of Criminal Defamation”.

The 22nd Law Commission of India was led by Justice Ritu Raj Awasthi and has recommended that the offence of criminal defamation should be retained in the new criminal laws. the Law Commission mentioned that it undertook an extensive study on the law of defamation following the Supreme Court’s decision in the Subramaniam Swamy vs. Union of India (2016) case. In this case, the Supreme Court held the freedom of expression as a “highly treasured value under the Constitution” and ruled that the reputation of a person is an integral part of the right to life granted under Article 21 of the Indian Constitution.
