4. 1) सुप्रीम कोर्ट को इस रेप के अनुसंधान पर केंद्रित रहना चाहिए था, कैसे यह अनुसंधान ठीक से हो, दोषी पकड़े जाए इस पर कोर्ट ने कोई ततपरता नही दिखाई। बल्कि उसने मामले को मोड़ दिया और डॉक्टरों द्वारा लापरवाही करने पर मरीज के परिजनों द्वारा होने वाली हिंसा के विरुद्ध टास्क फोर्स गठन कर कड़े नियम कानून बनाने के निर्देश दे दिए। ऐसा करते वक्त सुप्रीम कोर्ट ने डॉक्टरों की लापरवाही से निपटने के लिए मरीजों की शिकायत का कैसे न्यायोचित निपटान हो इस पर कुछ नही कहा, ऐसा लगता है कि कोर्ट सिर्फ डॉक्टरों के प्रति संवेदनशील है, और मरीजों के प्रति उसकी कोई संवेदनशीलता नही है।

   2) पोस्टमार्टम RG KAR HOSPITAL में नही कराया जाना चाहिए था, क्योंकि हो सकता है कि हत्यारे स्वयं उस पोस्टमार्टम करने वाली टीम का हिस्सा हो और उनलोगों ने हत्या की असली वजह को रिपोर्ट ही नही किया हो।

   6) सबसे अहम प्रश्न यह है कि क्या सेमिनार रूम का प्रवेश द्वार cctv के दायरे में था? क्या सेमिनार रूम में प्रवेश करने का और कोई जरिया भी था? हत्या और रेप कही और हुआ और लाश को सेमिनार रूम में रख दिया गया, इस सम्भावना पर भी विचार करना चाहिए। हो सकता है कि संजय राय बलि का बकरा हो और हत्या में अस्पताल में उस वक्त मौजूद डॉक्टर,नर्स, स्टाफ या मरीज का परिजन भी इस अपराध में संलग्न हो।

   7) CBI सबसे बड़ी जांच एजेंसी भले हो। लेकिन अनुसंधान के मामले में उसका ट्रेक रेकर्ड ठीक नही है। दरअसल पुलिस शुरुवाती तहकीकात में गम्भीर त्रुटि कर देती है जिससे पूरे मामले को सुलझाने का रास्ता बंद हो जाता है।
