So, you’re getting interviewed by the cops and you decide to remain silent until your attorney is there. They say your silence will be held against you… What should you do?
As a lawyer, here’s my advice: Say, “I am invoking my 5th amendment right to remain silent and I will not answer any more of your questions until my lawyer gets here.” DON’T just sit there quietly and ignore them. Keep repeating that sentence until your lawyer arrives to the police station and defer to them whether or not to speak.

If you have to verbally invoke your right to remain silent, then you don't have a right to remain silent🤔

The fifth amendment only applies if it is a question about you committing a crime or connection with a crime. So if you're unquestionably a witness and you refuse to say anything you could get in hot water

The investigators will pressure you saying they can’t help you if you do not talk to them despite you already asking for an attorney or verbally pleading the 5th.

It is always best to tell a cop you are exercising your 5th Amendment rights!
Then you don't have to say anything.
No inference should be made by cops, prosecutors, or judges when one invokes their 5th Amendment rights.
So the way i see it is if you are doing something wrong and you would like to hope you can get out of it by suing yeah but if you interact with police and you aren't committing a crime 99% of the time just answer the questions and move on
The fact that you have to expressly invoke your fifth amendment rights is precisely the problem.

Bullshit! If we have the right to freedom of speech (lol) then by corollary we also have the right to freedom of silence. Silence does not imply guilt. Lawyers and judges have failed again!!!
