  3. Judge a lost perspective there. It's not the client's fault the attorney isn't there and then to give them no bail. I don't know the charges but if he would have given bail if the attorney had been there. He's going after the wrong person and he looks to be impartial

  5. For those of you who are curious, this is from a TV show called Court Cam. This hearing took place in Broward County. The defendant is Yanelly Morales. She was charged with burglary after breaking into a house belonging to a woman she thought was having an affair with her boyfriend.

    The issue here is that this defense attorney has an "appellate attorney" at the public defender's office who wanted to handle this process as the attorney of record. That attorney wasn't available until 1:30p and what you're watching here took place around 9:30a. This is a common request. Ms. Morales, if she agreed, would simply sit in lockup until that afternoon or, if the judge did not have hours, until the next session.

    As a matter of fact, three days later that's exactly what happened. She made $10,000 bond.

    What you don't see is that the missing attorney spoke to this guy on the phone and told him she was on her way, but was delayed. Hence the judge became angered and we get the "hung out to dry" line.

    Judge Michael Davis is currently (2024-MAR-30) on the Seventeenth Circuit Court in Florida, having been appointed by Ron DeSantis. He got his JD from Hofstra and formerly worked as a child's rights advocate in family court.

    Maybe he was in a car accident, maybe in rushing to court he fell down some stairs.

  8. I can understand being upset that the attorney isn’t there, definitely seems like it’s happened a lot previously, however, the defendant shouldn’t be held accountable for a public defender not showing up.

  9. Someone being held without bail because a government public defender didn’t show up? Sounds more like the public defender should sit in jail.

  10. I agree with the judge. As a public defender you should be there to represent your client. They have ample time and opportunity to request a continuance.

  11. What if there is a legitimate reason? They give judgeships out to the highest bidder, these days, apparently.
