15. Scottish Law has many differences from that of England, a major one is 'common assault' where simply one party could be prosecuted for shouting in the face of another. This law is seldom prosecuted as the cops really will only take action when they have Evidence about the event, there was no provocation that may nullify the prosecution and the Evidence is well supported; any law that creates areas of doubt may well fall into the same category and action will only be taken when there is hard evidence that the law has been broken. The new hate crime in Scotland is seriously worded yet it is really not that far removed from laws in England, Sweden, Denmark and in line with policy of international bodies EU and ECHR. Scotland does face long standing issue of ingrained bigotry which are quite different from England and a future reunified Ireland may cause many from the Iron North to move into Scotland just as the Southern Irish centuries ago moved in large numbers into the West of Scotland, so for many the wording used in formulating these Laws and adapting the previous 2020/21 'hate laws' is really of no surprise, the expected outcome will not impact free speech.

Why is Rowling living in Scotland its seems apparent JKR detests recent Scot Govt 'Hate' legislation (which was passed with a massive majority by the Scottish parliament) this legislation is almost exactly in line with legislation passed in England in 2006 & 2008 and JKR references the previous Trans Gender legislation revoked by the UK Government; Just as the FM Walked the Spanish; 16/02/2023 implemented a transgender Policy highly similar as the bill passed unilaterally by the Holyrood devolved Govt. "After months of sometimes heated debate within the ruling left-wing, Spanish MPs on Thursday gave final approval to a law allowing people to freely change their gender from the age of 16…" – The EU nations are now passing their own Transgender Legislation and the same 'Hate' legislation is already in place.

Maybe JK Rowling might like to report Humza Yousaf to the police for his tirade about the dominance of 'white' people in Scottish high offices (in a country where 95% of the population identify as white). Under the terms of his own government's new 'hate speech', law one could certainly make a very convincing argument that his speech was offensive to an 'ethnic group', indeed, to Scotland's majority and indigenous 'ethnic' group.
