Believe it or not, this is one of the most common questions any criminal defense lawyer gets from clients. Sometimes people make no statements to the police at all when arrested, but recall later that they weren’t read Miranda warnings.

Miranda rights, or more accurately, Miranda warnings, advise a person facing interrogation in an investigation for felony or misdemeanor criminal offense that they have certain rights. The important Fifth Amendment and Sixth Amendment rights you are to be reminded of are that you have a right to consult an attorney before making any statements, and that you in fact have a right to remain silent.
