How did the US state of Michigan become the first government in the entire English-speaking world to ban the death penalty in 1846?

Two death row cases in particular seemed to influence public opinion and lead to a growing movement to abolish the practice.

    I have heard that on one occasion the Blessed One was staying at Nalanda in Pavarika's mango grove. Then Kevatta the householder approached the Blessed One and, on arrival, having bowed down, sat to one side. As he was sitting there he said to the Blessed One: "Lord, this Nalanda is powerful, both prosperous and populous, filled with people who have faith in the Blessed One.     A second time… A third time, Kevatta the householder said to the Blessed One: "I won't argue with the Blessed One, but I tell you: Lord, this Nalanda is powerful, both prosperous and populous, filled with people who have faith in the Blessed One. It would be good if the Blessed One were to direct a monk to display a miracle of psychic power from his superior human state so that Nalanda would to an even greater extent have faith in the Blessed One."

    A third time, the Blessed One said to Kevatta the householder, "Kevatta, I don't teach the monks in this way: 'Come, monks, display a miracle of psychic power to the lay people clad in white.'

    "Kevatta, there are these three miracles that I have declared, having directly known and realized them for myself. Which three? The miracle of psychic power, the miracle of telepathy, and the miracle of instruction. ………..

    …"And what is the miracle of instruction? There is the case where a monk gives instruction in this way: 'Direct your thought in this way, don't direct it in that. Attend to things in this way, don't attend to them in that. Let go of this, enter and remain in that.' This, Kevatta, is called the miracle of instruction.

    … "A householder or householder's son, hearing the Dhamma, gains conviction in the Tathagata and reflects: 'Household life is confining, a dusty path. The life gone forth is like the open air. It is not easy living at home to practice the holy life totally perfect, totally pure, like a polished shell. What if I were to shave off my hair and beard, put on the ochre robes, and go forth from the household life into homelessness?'
    "So after some time he abandons his mass of wealth, large or small; leaves his circle of relatives, large or small; shaves off his hair and beard, puts on the ochre robes, and goes forth from the household life into homelessness.
    "When he has thus gone forth, he lives restrained by the rules of the monastic code, seeing danger in the slightest faults. Consummate in his virtue, he guards the doors of his senses, is possessed of mindfulness and alertness, and is content.

  3. I am from Michigan and am proud of its ban. People make mistakes that they, hopefully, can correct. Can't correct an execution. But I never knew that MI was even among the first. Thank you BBC.

This binding legal instrument prohibits countries from carrying out an execution and, by its design, has no legal means to withdraw. Furthermore, in 2001, the Supreme Court of Canada ruled that even returning a prisoner to another jurisdiction where they may face execution is a violation of the Charter of Human Rights.
    The last motion to return the death penalty was debated in Canada’s parliament in 1987. It was defeated by a vote of 148 to 127. The leaders of all major parties at the time opposed the death penalty but permitted members to vote freely.

  10. What’s always been confusing about the death penalty in the US is that the vast majority of those supporting it also follow Jesus. Yet Jesus was quite explicit about stuff like this: “You have heard that it was said, 'Eye for eye, and tooth for tooth.' But I tell you, do not resist an evil person. If anyone slaps you on the right cheek, turn to them the other cheek also.” (Matthew 5:38-39)

    Personally, I’m against the death penalty for one main reason: risk involved in executing innocent people. If I were on a jury where the possibility of the death penalty were involved, I’d be mighty reluctant to convict as there could always be the possibility of a mistake. 12 Angry Men is essential viewing here.

  14. In case people are wondering, Michigan did abolish the death penalty except in cases of treason in 1847 (not 1846). That was corrected in 1962. Wisconsin was the first state to abolish the death penalty for all crimes, including treason, in 1853. Maine abolished the death penalty in 1887.
