14. There is a drink driving defence of "not intending to drive." It has worked for truck drivers spending the night in their cabs. As so often, the law is an ass: the offences should be driving while drunk/on the phone.

    They were both tipsy but he had , had the sense to give his car keys to his mate before hand who was still inside the club they had come out of .
    The police searched him and could not convict him of anything at all .

21. Here’s an interesting scenario that I’ve been wondering about for a while.
    There are several roads between England and Scotland, including but not limited to the A7, A1, and A68, which have a lay-by on them which straddles the border, and at least in the aforementioned examples, the sign welcoming motorists to Scotland is located a short distance from the border itself, so if a driver parked in the lay-by was breathalysed and was found to be over Scotland’s alcohol limit but under England’s, would they have a defence if they proved that they were parked on the English side of the border, and if so, what would happen if the car was straddling the border?

On a slightly different topic, I was watching a YouTube video and a police officer demanded a driver show him his driving licence, the driver asked the officer what section of the Road Traffic Act are you using? The officer couldn’t answer the question other to say I know the law exists that you have to show me your licence. Does the officer have to quote the section he is using or just know one exists?

Or just some idiot who was dumb enough to sit in his car with his keys on him and think because it called drunk driving he has to be driving at the time. Drunk in charge…. Got to love the internet.
