"If you are riding in a car in California and you and your companion are stopped by the police, and your companion, who is a felon, has firearms in the vehicle, is it possible for you to face charges related to the firearms? I was personally taken to jail in a similar situation, so it seems that charges can be brought against someone in this scenario. However, I have no previous criminal record. I appreciate your response in advance!"

  4. I am charge for gun possession find in a vehicle, I wasn't driving it. It's been 11 months prosecution haven't submitted no CSI reports yet no fingerprints evidence or GSI ,I'm still waiting for them to present it. Could the court take later submission

  5. US inhabitants may praise themselves lucky for living in a country with so many rights and amendments to the constitution. It must be a paradise for criminals. Where I live (Europe) we don't have all these "convenient" laws to get away with criminal behavior. As a result, we have a far lower crime rate and less violence in our society. Being a vurnerable citizen, I prefer our legal system over yours anytime.

  8. What to do if the arresting officer lied in there report? The trooper stated that "I knew there was a gun in the truck and that I was a convicted felon" The gun was behind the back seats of a 4 door truck owned and operated 90% of the time by my wife. I never said at anytime that I knew the gun was in the truck. That would be stupid to say that even if you did know there was a gun in the truck. This time I'm innocent! And the virginia state trooper says he has no body cam footage. My wife is the one that told them she knew the gun was in the truck and I had no knowledge of the gun being in the truck. So am I just screwed?

  9. Even if you don't give the officer consent to search your vehicle,he still does it anyway and justify is search by saying he was talking inventory of every thing u have in there cause your vehicle is going to get towed,can they do that

  10. My son in law is in prison now because his pick up broke down and he left a shotgun in it as he walked to get help . He was arrested for possession of a firearm because he is a felon . So my question is; since the supreme court just said that it is a 2nd amendment right for all except violent criminal to have and bear arms , will he be getting released.   11. why does no one defending this charge mention that the law ACTUALLY says: "…to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce." This is about shipping and transporting in commerce, not possession.

    It seems illegal to me that they were hovering around the vehicle when the x felon was not in the vehicle at the time of their call

I was at a store not even in my girlfriends car i had a warrant they arrested me on the warrent searched her car without permission found 3 guns took one of the legally owned guns and charges me with felon in possession even though I wasn't in her car and told them it wasn't my car.   14. This one is for books, i live in nc, 30yrs ago i was charged on a domestic violence ,went to court and found not guilty, when ths judge wrote up the verdict, he screwed it somehow. Now when i go to buy a pistol, i get turned down thru ncis check, but when i go to buy a rifle it will get Approved, go figure that one out

  16. A GPS tracker was placed just inside our threshold by the arresting office when initially answering the door which is how forcible entry upon the initial answering of the door was justified.

  17. So what if it's not regarding a traffic stop? What if it is a search of a home when the gun was found in a safe but the warrant was not conducted legally? Illegal search and seizure/with-out knowledge of the firearm being in the safe of a non- violent convicted felon, come to find out the firearm is stolen but no knowledge of that at the time of the warrant being conducted, is it possible to beat the gun charge?
    The gun was placed in the safe by a roommate that during the search was found with drugs and firearms…
    The officers held us in the home until the warrant was signed by the judge with out permission to enter, the warrant wasn't even for the drugs or guns but for receiving stolen property/ theft of an electronic device.

  18. Recently received this charge and have court in october im assuming because I let the officer know I had my own registered firearm on me that I will most likely not beat it. Sucks you need paperwork for something the constitution states is a right.

  20. The second amendment, article 4 section 2 paragraph 1,14th amendment section 1 protects all American citizens right to possess and Cary a gun openly or concealed everywhere in the united states of America.

  21. Searches of a citizens vehicle without a legal lawful search warrant are a violation of the 4th amendment warrant clause and the 14th amendment section 1, and article 4 section 2 paragraph 1 of the constitution of the united states of America.

  22. Probable cause is only to get a legal lawful search warrant, the 4th amendment text explicitly states no warrant shall issue but upon probable cause.

    And nowhere in the 4th amendment supreme law of the land do the words reasonable Articulable suspicion exist whatsoever. The 4th amendment establishes that the only reasonable search and seizure is done with a legal lawful search warrant.

  24. hello there I was sitting in a friend's car my friend was driver I was passenger the police pulled up and said we were sitting in a tow Zone but we also had on our hazard lights he asked her for her driver's license she gave him the driver's license he came back and said you have an order of protection on you she said yes that's my little brother and I got into a little scuffle so we can't be around each other for a little while the police officer said well since you have an order of protection on you I'm going to have to ask you guys to get out of the car they proceeded to open all the doors pull us out and then they found a backpack in the backseat of the car with a gun and they pulled something off of my hip so now I have two uuws do you think there is possible evidence suppression going on here
