   A group of police officers was enforcing a checkpoint somewhere, when Berto suddenly passed by and looked around. When he confessed at the checkpoint, the police stopped him to conduct an inspection, but Berto suddenly sped off. When a citizen saw what happened, he tried to block Berto, but he kicked him in the stomach and fell on the road, resulting in him having scars on his body.

   Is Berto liable for indirect assault?

   Answer: No, because there is no indirect assault, if there's no direct assault.

Good day po attorney, ask ko lang po doon sa example #1 sa indirect assault, paano po naging DIRECT ASSAULT 'yun kung wala po ang element #3 ng 2nd form of direct assault which is (a) PIA or APIA is engaged in actual performance of official duty (?) since private citizen po ang tumulong.
