  1. A juror should not have the knowledge of elements of a crime, though,so how can this be a consideration for them to make a decision?

    Trier of fact.

    Preponderance- more than 50%
    Clear and convincing
    Beyond a reasonable doubt

    Affirmative defense.

  3. In this example, the reason the stolen property would be inadmissible is b/c of it was a 4th amendment violation, but if it was a 5th amendment violation (or just a Miranda violation?), THEN the physical evidence would be admissible, right?
