The Facts: My client had one shot at a bar where she works. She looked fantastic on camera and the cop testified that she blew a whopping “.165” on the Preliminary Breath Test (PBT). There was no proof (in fact, on video, they said it was “.156, 157… something like that..?” Making their determination suspect since they never preserved the number on their badge cams NOR ever photographed the number on the PBT (takes 2 seconds).

At one point, the officer slips up and mentions the inadmissible PBT, on accident. So, naturally, I jump on it IMMEDIATELY. I try to convince the judge we can talk about it but the number can’t get in, WHICH IS THE LAW. She declines. Says “all or nothing;” so I go for broke. It pays.

Jury doesn’t believe the cop. Acquits my clients who looks and talks SOBER on camera.

They even acquit her of the reckless driving charge because as one juror later told me “all 6 of us had gotten lost by GPS and taken down the wrong way on these streets before, so we know….”

  1. And another thing that needs to be changed is when a cop is investigated , other cops don't do the investigation, citizens do the investigation. Have like a jury of 6 or whatever and have them decide if the cop is guilty . You trust a jury will do the right thing in criminal trials so you trust them in investigating cops .

Number one 90% when a cop charges you with resisting arrest , they have not arrested you on any thing yet , so really what it is that the cop is doing is lying and he's the one assaulting you because you have been charged with anything yet. It's hilarious when watch cops say STOP RESISTING it's simply a con to conjure up bogus charges. You can't resist if you have been charged with any thing. What also is that you have the right to defend yourself , so if a cop is putting his hands on you and your not arrested for anything then you should have the right to defend yourself.

  3. That is their "go to charge". One of them anyway. It's either resisting or disorderly when the person hasn't even done anything to deserve the charge. That's nuts.

  10. That stupid pig should be put in prison for wrongful. Arrest he should never be allowed in public. Putting him in prison, let the prisoner stretch his butt like it's never been stretched.

  14. This why a citizen should plead " Habeas Corpus ",when police officer take a citizen in to custody . Habeas Corpus means I surrender, I plead innocent and I want to see the judge to contest my arrest ! Habeas Corpus is your first constitutional right of a US citizen as per Article 1 Section 9 paragraph 2 .
