Can we say the same for the burden of proof that will be put upon men under Section 375 and Section 376, if the exception for spouse is struck down.
Post that, a man who admits to have had sex with his wife but post her consent will be put behind bars.
Indian Evidence Act presumes the lack of consent under the lack of any other evidence to prove otherwise.
Here an Innocent Man will be put behind bars for minimum of 10 yrs to Lifetime imprisonment, just because you are not invested in the Right to Fair Trail of a man who is falsely accused.
There is no way a man will be able to prove that he had consent as you know as per the standard practice by lawyers, any person that can be of any value to the accused as the witness, are listed as co-conspirators and accused as well.
Whole family is slapped with false charges.
Although you told the court that sentence should be reconsidered by a Sentence Board but will it be, but that too because you mentioned higher sentences hurt victim's (women's) case as judge will be reluctant to issue sentence on loose evidence, which will lead to higher acquittal. You are not at all worried that an innocent man can be framed and a lot of them will definitely be framed, given the current misuse of gynocentric laws.
With all due respect to your knowledge and expertise in law, you appear to be biased, probably because of the personal experiences you mentioned.

Madam does not believe in strict liability of criminal act, since carrying a reformative mind set as defence counsel to take out criminal out of axe and that is why she got a convincing reply from judge that Talwar should definitely be spared as they do not have other daughter to kill….

Awesome speech, well grounded and truth as it exists that we confront each day particularly in the trial courts.
It is a shame that a criminal lawyer like Rebecca John couldn't see clearly that the Talwars killed their daughter, or is she pretending that she couldn't see it??? The whole country knows that the Talwars killed their daughter and servant. There is a saying that you should not hide anything from a lawyer and a doctor…. She definitely knows who the criminal is and who murdered Aarushi and Hemraj…. If indeed she knows the murderer, she, being a Christian, will be judged very badly at the Bema seat of God…If Rebecca John is reading this, she should stop supporting the Talwars and help to bring to justice the criminal(s) rather than licking the Talwars' butts for money…
