  1. I imagine an appellate attorney has to hang on to the small % of wins to be able to keep moving forward with their work.

  2. Love what Michael said about the reason he does his work. It’s so crucial to have fair trials so that we can believe in our judicial system.

  3. I love how excited Michael is about the appellate process. It’s good for those who truly deserve to have an appeal.

  4. I would expect the Successful appeal rate to be low otherwise it means that the legal system isn't working properly

  5. Incredibly informative – I really enjoyed going deep where Michael discusses executive counsel Criminal Law Section – the art of the trial being lost. I feel like that alone could be an entire future episode. I also would like to have been able to ask what current trial judges/court rooms need to be doing to appeal proof cases. Not to talk him out of a job, but he would be an excellent resource for "continuing education" or procedures/protocol for courtrooms across the country (updates due to media, cameras, phones etc….).

  11. As someone that doesn’t know anything about anything but really likes history and learning…I have thoughts on this PCA. If the reasoning is because the majority of these opinions are “asked and answered” per se, then perhaps there should be stock answers that say “see opinion x, y or z”. How can the attorneys receive any feedback? How can future folks learn? How can the judges thought process be captured in time? The contingency that PCA’s can’t move before might seem more valid and provide information for others that may help (even cut down) with future filings. Or remove the contingency. Because then an attorney would know what the judge was thinking and could potentially challenge it. It would give the judge pause before putting those stock answers in writing. They would be forced to document if the answers really apply. Ok. Good talk. 🫶🏼
