How in the world do you explain that to the husband and the wife? Simply saying, I know secrets about the husband that I cannot tell the wife so therefore you must get new lawyers. Doesn't that give up confidentiality just by doing that?

About the only safe thing she can do if she doesn't want her husband to have the money is to have the check deposited into a joint savings account that she and her husband both have full access to… Then she can spend the money because the money is equally hers as much as it is his. Notice I did not say that she could withdraw the money or transfer the money. If she just takes the money then that will come up during the divorce proceedings and she may very well be required to pay either all of it back or at least half of it back to him during the divorce. If it's spent however and she legitimately buys things with it then that would just be a normal course of events for a joint bank account. There may be some more mitigating factors with that plan depending on the exact divorce law in your state but generally money that is spent is considered gone and a part of normal activity for a joint account versus money that you withdraw either right before or during the divorce proceedings is seen as you attempting to hide that money from your significant other.
